I'm a former avantair employee and looking for some help. Does anyone know how I would go about getting my W2 from this company that no longer exists. I know by law they are supposed to send it but obviously I can't imagine that anyone from this former company is taking cate of this.
I would greatly appreciate some advice on how to obtain my W2.

the payrol at VNR was through ADP. they are a reputable company and still in business. sit tight, it will show at your last address of record.

Are you sure that is the correct answer. I can understand that ADP is a quality company but given there is no administration at Avantair and the fact ADP is not getting paid I question whether they will send them. Under law the "company" has to provide the W2 but there is nothing about that mandate being made to the payroll servicing company. All w2's have to be sent by end of January so if you don't get it there are specific IRS instructions on how to do you tax return without it.

Unfortunately it doesn't sound like we will be receiving a W-2. I can still access my records on the ADP website and I'm sure you can too. You can print your last paycheck and use that to file your taxes. If you need help getting on the site I will help you. I have had this exact situation with another airline and we did NOT receive a W-2, but I had no trouble filing my taxes that year.

Do I have to wait until February 15 to file my taxes? The Avantair W-2 (or lack thereof) is the only item remaining on my taxes. I am due a refund, and the sooner I could get it, the better.

You need to contact the IRS and get form 4852 completed.

So how do we access ADP website and receive a last pay check statement? I called and they asked for a login from only authorized individuals the deal with payroll.

You can click the forgot username or password and hopefully you can figure it out. I've checked though, no update or W2 on the site. I called the IRS and they said the Bankruptcy Trustee is responsible for getting the W2's out. I've emailed and called her but no reply. I'm sure the trustee has already taken her cut from the auction so I doubt they care about us, not that they ever did.

IFLY2 above is correct. My suggestion is to send a certified letter to the Bankruptcy trustee and make sure you have a copy for the IRS. Also get further information as to the possibility of filing estimated income data for your tax return.
Also remember that the company may not have submitted all your taxes withheld since tax money is usually the first thing being omitted during financially troubled times.
Continue to try and reach all parties concerned i.e. ADP payroll service to get any information possible.
